Terms of Service

Welcome to The Stack (in Spanish, La Pila), a free app for keeping track of the movies, TV shows, books, and video games in your life. The Stack is built and run by Almudena Bernardos, an independent developer based in Spain. These terms are the agreement between you and her when you use the app at its.onthestack.app, the site at onthestack.app, and the mobile apps when they arrive. They are meant to be read, not skimmed, so they are short.

1. What The Stack is

The Stack is a personal media tracker. It is completely free, and every feature is available to everyone. It is also a solo passion project, provided as-is: there is no guarantee that it will always be available, uninterrupted, or bug-free, though keeping it healthy is very much the goal. The operator also reserves the right to wind the service down. If that day ever comes, you will be told in advance, in the app or by email, with enough notice to close things out.

2. Your account

You do not need to sign up to use The Stack. When you first open it, an anonymous account is created for you automatically, and everything works from there. Adding an email address is optional. It does one thing: it makes your library recoverable if you lose your device or switch to a new one. You are responsible for keeping access to your own email inbox, since that is how your library is recovered. If you sign out, the app returns to a fresh anonymous state on that device.

3. Fair use

The Stack is for personal, non-commercial use. Please do not:

• use it in any abusive or unlawful way;
• use bots, scripts, or automated or bulk access;
• attempt to access other users' data;
• use the app to scrape, extract, or redistribute the third-party catalogs it displays.

Accounts that break these rules can be suspended or closed, as described in section 8.

4. Catalog content from third parties

Titles, metadata, and images in The Stack come from third-party sources: TMDB (movies and TV), IGDB (video games), Open Library (books), AniList (manga), and Metron (comics). That content remains the property of its providers and their licensors. Accuracy is not warranted; if a release date or a cover looks wrong, the source data is the likely culprit.

This app uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB.

5. Support the Dev

The Stack offers an optional tip to support the developer. Tipping unlocks nothing: no features, no content, no ad removal (there are no ads). Every tip is started by you; nothing is ever charged automatically or on a schedule. You can tip once or as often as you like. Refunds are handled by the platform you tipped through: Apple, Google, or Stripe on the web. Your statutory consumer rights, including EU withdrawal rights where applicable, are not affected by anything in these terms.

6. Who owns what

The Stack app, its design, name, and code belong to the operator. The catalog information you see (titles, artwork, details) comes from third-party sources and belongs to its respective owners. Your tracking records, meaning what you save and the statuses and dates you set, are your personal data and are handled as described in the privacy policy.

7. Limits on liability

The Stack is free, and its liability terms reflect that. To the maximum extent permitted by applicable law, the operator is not liable for indirect damages, lost data, or losses arising from your use of, or inability to use, the service. Nothing in these terms limits mandatory consumer rights under EU or national law, or any liability that cannot be excluded by law.

8. Leaving, and suspension

You can stop using The Stack whenever you like, and you can delete your account at any time; deletion works as described in the privacy policy. The operator may suspend an account that seriously or repeatedly breaches these terms, for example through abuse or attempts to access others' data. Any suspension will be proportionate to the breach, with prior warning where feasible, and you can always write to hello@onthestack.app to object or ask for review.

9. Changes to these terms

These terms may change as the app evolves. Material changes will be announced in the app or on onthestack.app with reasonable notice before they take effect. If you keep using The Stack after that notice period, that counts as accepting the updated terms. If you do not agree with a change, you can stop using the service and delete your account.

10. Governing law

These terms are governed by Spanish law. If you are a consumer in the EU, you always keep the mandatory protections of the law of your country of residence, and you may bring or face claims in the courts of that country.
